Aereo wins partial victory in broadcasters' suit

NEW YORK (AP) ? Aereo, a startup that takes live TV broadcasts and sends them to mobile devices in New York for a monthly fee, has won a partial victory in court over the media companies that are suing it.

U.S. District Court Judge Alison Nathan in New York dismissed one of three claims made by the broadcast companies, which include ABC, CBS, NBC and others in a ruling released Monday.

Nathan dismissed the claim of unfair competition, saying it was pre-empted by the Copyright Act.

Two claims of copyright infringement remain. A hearing on a preliminary injunction begins May 30.

The broadcasters have argued that Aereo is copying and retransmitting their programming unlawfully. Aereo contends that by assigning miniature antennas to each of its users, it is providing legal access to free over-the-air broadcasts.

An Aereo spokeswoman declined to comment.

A spokesman for News Corp.'s Fox said the judge's dismissal of the unfair competition was on "technical grounds" and didn't judge the merit of the copyright claim.

"We look forward to our day in court to prove that Aereo's unauthorized streaming of our content constitutes copyright infringement," the spokesman said in a statement.

The case is being closely watched because of the precedent it could set. Broadcasters owned by The Walt Disney Co., CBS Corp. and Comcast Corp. have deals to collect hundreds of millions of dollars annually from cable and satellite TV providers for the right to retransmit their signals to subscribers.

Such signals are also available freely using an antenna, but most TV households pay for service through a provider. If Aereo's service is found not to infringe on broadcasters' copyrights, it could upend a system that has created a profitable new revenue stream for media companies.

Leaks of papal documents are 'criminal,' Vatican charges : News ...

The Vatican has denounced the publication of secret papal documents as "a criminal act," after an Italian journalist launched a new book full of leaked correspondence.

Gianluigi Nuzzi, who helped to trigger a furor over secret Vatican memos when he exposed some documents in January, released his book His Holiness on May 19. The book consists of correspondence to and from Pope Benedict XVI.

"The Holy Father and a number of his collaborators, as well as the senders of messages addressed to him, have had their individual rights to privacy and freedom of correspondence violated," the Vatican said in an angry statement responding to the book's publication. The statement said that the public release of these confidential documents "no longer appears as a questionable--though obviously defamatory--journalistic initiative, but clearly assumes the characteristics of a criminal act."

The statement indicated that the Vatican would continue investigating the internal leaks, and could take legal action against those who published the documents.

The leaked documents obviously come from one or more Vatican officials with access to sensitive correspondence. Suspicions have centered on the Secretariat of State, especially since the leaked documents generally portray the Secretary of State, Cardinal Tarcisio Bertone, in an unfavorable light.

Pope Benedict has appointed a high-level commission, consisting of three retired cardinals, to investigate the source of the leaks. The latest embarrassing releases, and the heated Vatican response, show that the matter the Holy See now considers the issue a major concern.

The United States has the Super Bowl, the World Series and March Madness, to name a few of the sports events that consume our attention for much of the year.

And yet, it turns out we may not be even close to the most dedicated sports fanatics out there. That is, if you judge dedication based on a person?s willingness to skip work in the name of sports.

A new poll finds that Americans are far less likely to call in sick to watch a sports event, or recover from watching one, than people in China, India and other countries.

Harris Interactive surveyed thousands of people in Australia, Canada, China, France, India, Mexico, the United Kingdom and the United States on behalf of Kronos Inc., which makes technology for human resources operations.

The researchers found that only 11 percent of Americans had called in sick to watch a sports event. Just 7 percent of the nearly 1,200 Americans surveyed had called in sick the day after a sporting event to recover from the excitement.

In China, a whopping 58 percent of respondents had faked a sick day to root for their favorite team. In India, 48 percent had done so. The United Kingdom? Twenty-four percent.

Only France ranked lower than the U.S. among the countries surveyed, with virtually no one admitting to calling in sick to see sports.

The Chinese and Indian respondents were also much more likely to cop to calling in sick the day after a sporting event, with 54 percent and 41 percent of those country?s citizens admitting to take a sports recovery day.

Even Canadians were slightly more likely than Americans to admit to that practice, with 9 percent saying they had done so.

The results had a lot in common with a more general survey Kronos commissioned last year. In that survey, seven in 10 Chinese workers admitted to faking a sick day for any reason, while fewer than two in 10 French respondents said they had done so. About half of Americans said they'd faked a sick day for any reason.

Rajat Gupta faces jury in insider trading case

NEW YORK (Reuters) - Barely a day went by at the insider-trading trial of multimillionaire hedge-fund founder Raj Rajaratnam a year ago without mention of Rajat Gupta, a boldface name in business and charity circles.

On Monday in the same federal court in New York, it will be Gupta's turn to go on trial. The former Goldman Sachs Group Inc and Procter & Gamble board member is accused of leaking stock secrets to Rajaratnam, his erstwhile friend and business associate who was convicted and is now in prison.

But while prosecutors have called Gupta the "illegal eyes and ears" for Rajaratnam, this is a very different case. At Rajaratnam's trial, jurors spent weeks listening to the Galleon Group founder discussing stock trades on calls secretly recorded by the FBI. With Gupta, prosecutors have no direct conversations on tape related to the trades central to their case.

One of the government's core allegations is that Gupta tipped Rajaratnam to Berkshire Hathaway Inc's $5 billion investment in Goldman during the 2008 financial crisis and Goldman's surprise fourth-quarter loss that year.

Gupta, 63, has pleaded not guilty. His lawyers have argued that others may have leaked information about Goldman to Galleon and that Gupta, who once led management consultant McKinsey & Co, had no reason to illegally spill corporate secrets.

"This is a classic reasonable doubt case," said Tom Dewey, a partner at law firm Dewey Pegno & Kramarsky in New York, who is not involved in the case. "The core defense message will be: 'There is just not enough evidence.'"

Gupta also is charged with providing non-public information to Rajaratnam in 2008 and 2009 about P&G.

A jury of 12 and four alternates will be chosen on Monday for the trial before U.S. District Judge Jed Rakoff, who expects it to last about three weeks. Opening arguments from Assistant U.S. Attorney Reed Brodsky and defense lawyer, Gary Naftalis, could start later Monday.

Gupta is charged with five counts of securities fraud and one count of conspiracy. If convicted, he faces up to 25 years in prison, though such a long sentence would be unlikely. Rajaratnam was handed an 11-year term in October, the longest for insider trading in the United States, after being overwhelmingly convicted on 14 criminal counts.

DECADES AT MCKINSEY

Gupta, the most prominent person indicted in the government's insider-trading crackdown, has had a remarkable fall from grace. Born in India, he earned an MBA from Harvard Business School and spent 34 years at McKinsey, serving as its global head for nine years. He retired in 2007.

He joined Goldman's board in 2006 and left in May 2010, seven months after Rajaratnam's arrest. Gupta, who was arrested last October, was also formerly a director at P&G and American Airlines Corp.

Naftalis has touted Gupta's charity, particularly his work to combat AIDS, malaria and tuberculosis, to rebut any possible government argument that he was motivated by money.

"He has had a wonderful, blameless life and out of the clear blue sky in the seventh decade of his life he decides to become a criminal?" Naftalis said at a pre-trial hearing.

Naftalis fought unsuccessfully to exclude three wiretaps between Rajaratnam and two traders that could implicate Gupta. But the judge said his ruling was not final.

Naftalis has not said if Gupta will testify in his own defense. Some high-profile witnesses could take the stand including Goldman Chief Executive Lloyd Blankfein, who also testified at the Rajaratnam trial as a government witness and said Gupta breached his fiduciary duty to the investment bank.

The case is USA v. Gupta, U.S. District Court for the Southern District of New York, No. 11-907.

As area residents kick off the summer outdoor activity season this Memorial Day weekend, the American Cancer Society is asking everyone to keep something in mind: protect your skin!

Skin cancer is the most frequently diagnosed cancer with more than 3.5 million skin cancers diagnosed each year in the United States. That?s more than all other cancers combined. And the number of skin cancer cases has been going up over the past few decades.

In an effort to raise awareness of skin cancer prevention, the National Council on Skin Cancer Prevention has designated the Friday before Memorial Day (May 25, 2012) as the fourth annual ?Don?t Fry Day.?? This pre-Memorial Day initiative is designed to help people stay well by raising awareness about the steps people can take to prevent skin cancer.

The National Council on Skin Cancer Prevention is comprised of more than 45 organizations?including the American Cancer Society?dedicated to skin cancer prevention in the United States. The American Cancer Society participates as a core member of the National Council and supports ?Don?t Fry Day? to help save lives. Most skin cancers are caused by too much exposure to ultraviolet (UV) rays. Much of this exposure comes from the sun, but some may come from man-made sources, such as indoor tanning lamps.

The good news is that you can do a lot to protect yourself and your family from skin cancer, or to catch it early enough so that it can be treated effectively. Finding possible skin cancers doesn?t require any x-rays or blood tests ? just your eyes and a mirror. If skin cancer does develop, finding it early is the best way to ensure it can be treated effectively.

Skin cancer is on the rise in the U.S.

  • There are more than 3.5 million new cases of skin cancer diagnosed annually, which is more than new cases of breast, prostate, lung and colon cancers combined.
  • Melanoma (the most serious form of skin cancer) incidence rates have been increasing for at least 30 years. Since 2004, incidence rates among whites have been increasing by almost 3% per year in both men and women.
  • The American Cancer Society estimates that 76,250 cases of melanoma will be diagnosed in 2012 in the U.S., and 9180 people will die from the disease.
  • Most skin cancers are caused by overexposure to ultraviolet (UV) radiation.
  • Sunburns during childhood increase the risk of melanoma and other skin cancers later in life.

While generous sunscreen usage (broad spectrum SPF 30 or higher) is an important way to protect yourself and your family, there are additional sun safety measures that can help prevent skin cancer:

  • Seek the shade when you can.? Use umbrellas or other shade structures when outdoors.
  • Remember that the sun?s UV rays are strongest between 10 a.m. and 4 p.m. and that may not be the hottest part of the day.
  • Wear sun-protective clothing, such as a long-sleeve shirt, a wide-brimmed hat, and UV-blocking sunglasses.
  • Do not intentionally tan or burn.? Do not use tanning beds.

Are some people more prone to sun damage?

Everyone?s skin and eyes can be affected by the sun and other forms of UV rays. People with light skin are much more likely to have sun damage, but darker-skinned people, including African Americans and Hispanic Americans, also can be affected.

The skin tans when UV radiation is absorbed, causing an increase in the activity and number of melanocytes, the cells that make the pigment melanin. Melanin helps to block out damaging rays up to a point, which is why people with naturally darker skin are less likely to get sunburned, while people with lighter skin are more likely to burn. Sunburns are thought to increase your risk of skin cancer, including melanoma. But UV exposure can raise skin cancer risk even without causing sunburn.

Aside from skin tone, other factors can also affect your risk of damage from UV light. You need to be especially careful in the sun if you:

  • Were previously treated for skin cancer
  • Have a family history of skin cancer, especially melanoma
  • Have lots of moles, irregular moles, or large moles
  • Have freckles and burn before tanning
  • Have fair skin, blue or green eyes, or blond, red, or light brown hair
  • Live or vacation at high altitudes (UV radiation increases as the level goes up)
  • Live or vacation in tropical or subtropical climates
  • Work indoors all week and then get intense sun exposure on weekends
  • Spend a lot of time outdoors
  • Have certain autoimmune diseases, such as systemic lupus erythematosus (SLE, or ?lupus?)
  • Have had an organ transplant
  • Take medicines that lower your immunity
  • Take oral contraceptives (birth control pills)
  • Take tetracycline, sulfa drugs, or certain other antibiotics
  • Take naproxen or certain other non-steroidal anti-inflammatory drugs (NSAIDs)
  • Take phenothiazines (major tranquilizers and anti-nausea drugs)
  • Take tricyclic antidepressants
  • Take thiazide diuretics (medicines used for high blood pressure and some heart conditions)
  • Take sulfonylureas (a form of oral medicine for diabetes)

Ask your doctor, nurse, or pharmacist about the risk of any medicines you may be taking that could increase your sensitivity to sunlight.

Skin exams

Most skin cancers can be found early with skin exams. Both regular exams by your doctor and checking your own skin frequently can help find cancers early, when they are easier to treat.

Get your skin checked by your doctor as part of a routine cancer-related checkup, your doctor should check your skin carefully. They should be willing to discuss any concerns you might have about this exam.

How to check your own skin

It?s important to check your own skin, preferably once a month. A self-exam is best done in a well-lit room in front of a full-length mirror. You can use a hand-held mirror to look at areas that are hard to see. A spouse or close friend or family member may be able to help you with these exams, especially for those hard-to-see areas like your back or scalp.

The first time you inspect your skin, spend time carefully going over the entire surface of your skin. Learn the pattern of moles, blemishes, freckles, and other marks on your skin so that you?ll notice any changes next time. Any trouble spots should be seen by a doctor. Follow these step-by-step instructions to examine your skin:

  • Check your face, ears, neck, chest, and belly. Women will need to lift their breasts to check the skin underneath.
  • Check the underarm areas, both sides of your arms, the tops and bottoms of your hands, in between your fingers, and under your fingernails.
  • Check the front of your thighs, shins, tops of your feet, in between your toes, and under your toenails.
  • Now use a hand mirror to look at the bottoms of your feet, your calves, and the backs of your thighs, first checking one leg and then the other.
  • Use the hand mirror to check the buttocks, genital area, lower and upper back, and the back of the neck. Or it may be easier to look at your back in the wall mirror using a hand mirror.
  • Use a comb or hair dryer to part your hair so that you can check your scalp.

Field Goals and the High School Football Game

The poor kicker. He's there on the sideline for 99% of the entire football game. He's expected to come in now and then, completely cold, and focus his energy and attention on the singular act of precisely kicking the ball through those dreaded uprights from varying degrees of distance. How can that be fun. On top of that, he kind of has outsider status in the locker room since his role is so different from anyone else in the team. The life of a high school field goal kicker is ripe with both stress and elation. Which one can flip a full 180 depending on his last kick. Let's look a little deeper at the prep football kicker and field goal, not to mention how we brought them squarely into our high school fantasy football league play.

Almost no player on a football team is so uniquely singled out as the field goal kicker. Football real is the quinticential team sport. You can't run with out a strong line. You can't score without a great defense giving you back the ball. It's all interwoven. Except for the kicker. He stands alone and that makes it a position that relies as much on mental toughness as physical skill and ability. When you walk out on that field as a kicker, you walk alone. Yea, special teams is out there for the protection and you do have your setter but those pieces are pretty much assumed to work. You're the one who has to perform. Spotlight's on.

Most high school football kickers either run dual duties with another position such as tightend or they come from a strong soccer lineage. It's such a specific skill set that the coach will usually check around the players at smaller schools to see who can pull it off on top of their usual position. Bigger high school programs usually have soccer players for which the kick, with a little practice, is pretty straight forward after years of developing foot control. This can affect the style of kick...either from the side or straight on. There's no right or wrong way unless of course, the ball misses the mark. That's the wrong way.!


The field goal is really a powerful tool and it's not exaggerating to say that many actual high school football games or won or lost by it's success. It's hard enough for any high school offenses to put together a successful touch down drive but getting down the field to a safe field goal range is going to happen much more often. A touch down is 6 points. At 3 points, the field goal is pretty potent since it's half the point total of the touch down and much easier to obtain. Although the field goal feels a bit of a let down from the full touchdown, it can quietly win the game for you after enough successful attempts. To account for this powerful point gaining ability, we kicked up the points for a field goal in our high school fantasy leagues to 3 points. This can quickly add up so you don't want to skimp on the kicker. It's actually not bad strategy to pick a team that has an average or poor offense since they might be in the position to kick more often than score a touchdown. When choosing your fantasy league players, don't kick them to the curb. Okay. That was stinky.

The little nugget is difficult to digest considering the slump we have had recently, and DLC revenue expectations aren?t exactly pretty either: While many were aware of it, only one third had actually purchased a DLC. Across the total age base surveyed, 50% played console games AT LEAST once a week, with the report arguing that "The console is still king: Console gaming has more players, money and time spent than any other platform."

What about Mobile and Social you ask? Glad you asked.

44% of the surveyed played mobile games at least once a week, with social at 37%. Hours played was an interesting statistic as well: 7.2 hours on average for console gamers, followed closely by social at 6.7.?

One dominating fact emerged though: Tablets and Mobile owners see games as a primary use for their devices, with only 'general internet access' eclipsing it. Tablet gamers average more than 20 game downloads, while mobile users averaging just over 10. Spending is higher for virtual goods with tablet users, averaging $62 dollars per user contrasted to $25 dollars for mobile gamers. Percentages confirm tablets are leading the mobile gaming industry, as 23% are spending compared to just 14% on smart phones.

Worryingly for Nintendo and Sony is that the survey proves the erosion of the handheld market:

Only 24% of those surveyed played a handheld game once a week, which is in stark contrast to the dominating 44% for mobile.

Vita and 3ds territory is being lost, and the recent sales figures for Sony are just further evidence consumers are slowly giving up on dedicated handheld devices in favor of robust, multipurpose devices like the iPad and iPhone.?At least they can take away the good news that their upcoming consoles should be met with enthusiasm, not just by the hardware market that has fallen flat as their old consoles age, but by the promise of enthusiastic spenders in a market that is still clearly dominated by home console gaming.
