A battle for Internet freedom as UN meeting nears

WASHINGTON (AP) ? Secret negotiations among dozens of countries preparing for a United Nations summit could lead to changes in a global treaty that would diminish the Internet's role in economic growth and restrict the free flow of information.

The U.S. delegation to the World Conference on International Telecommunications to be held in Dubai in December has vowed to block any proposals from Russia and other countries that they believe threaten the Internet's current governing structure or give tacit approval to online censorship.

But those assurances have failed to ease fears that bureaucratic tinkering with the treaty could damage the world's most powerful engine for exchanging information, creating jobs and even launching revolutions, according to legal experts and civil liberties advocates who have been tracking the discussions. Social networks played a key role in the Arab Spring uprisings that last year upended regimes in Egypt and Tunisia.

Russia, for example, has proposed language that requires member states to ensure the public has unrestricted access and use of international telecommunication services "except in cases where international telecommunication services are used for the purpose of interfering in the internal affairs or undermining the sovereignty, national security, territorial integrity and public safety of other states, or to divulge information of a sensitive nature," according to a May 3 U.N. document that details the various proposals for amending the treaty.

The wording of this provision could allow a country to cite a U.N. treaty as the basis for repressing political opposition. The provision also appears to contradict Article 19 of the U.N. Universal Declaration of Human Rights, which says people shall have the right to access information "through any media and regardless of frontiers."

An amended treaty would be binding on the United States if it is ratified by the Senate. But approval is not automatic. The treaty is sure to be scrutinized by lawmakers wary of its potential impact.

The U.N.'s International Telecommunication Union, which oversees the treaty, does not operate like the U.N. Security Council, where the United States has the power to veto resolutions to which it objects. The ITU works on a consensus basis. Proposals can be stopped from serious consideration if enough countries voice their objections. More than 190 nations will attend the Dubai conference and the U.S. delegation is seeking support for its positions at the preparatory meetings that will continue until the conference convenes.

"It is important that when we have values, as we do in the area of free speech and the free flow of information, that we do everything that we can to articulate and sustain those values," Philip Verveer, deputy assistant secretary of state and U.S. coordinator for international communications and information policy, said in an interview.

The drafting and debating of proposals in preparation for the Dubai conference have taken place largely behind closed doors. Public interest groups have criticized the process and said it runs counter to development of sound public policy. In response to calls for transparency, two research fellows at George Mason University's Mercatus Center launched the website WCITLeaks.org earlier this month as a way to make documents that have been leaked to them by anonymous sources available publicly.

The negotiations have sparked rumors that the U.N. and the ITU are plotting to take control of the Internet from the loose coalition of nongovernmental organizations that establishes Internet policies, standards and rules, they said. The ITU's secretary general, Hamadoun Toure, has called the takeover rumor "ridiculous."

The ITU said the preparatory process is open to all member states as well as hundreds of private sector and academic organizations. The member states, not the ITU, determine the rules of participation and are free to share documents and information as they see fit, the agency said in an emailed statement.

The treaty, known formally as the International Telecommunications Regulations, was developed in 1988 to deal with global telephone and telegraph systems that were often state-run. The conference in Dubai, which is being run by the ITU, will be the first time in more than 20 years that the treaty is being opened for revisions.

Independent organizations, including the Internet Society, the Internet Corporation for Assigned Names and Numbers, and the Worldwide Web Consortium, for years have served as the Internet's governing bodies. They handle core tasks like network and domain name administration and make decisions based on input from the public and private sectors. This system allows the Internet to evolve organically and react rapidly to changes in technology, business practices and consumer behavior, according to open Internet advocates.

Yet for countries still grappling with how communications have been transformed by the Internet, ITU and the treaty are viewed as the best avenues for plugging themselves into the global information economy. For developing nations that don't have an effective broadband infrastructure, bureaucratic and regulatory measures can allow them to benefit financially from the traffic that crosses their borders.

But treaties are static instruments that often are unable to adapt and adjust to the fast pace of Internet innovation, said Sally Shipman Wentworth, senior manager for public policy at the nonprofit Internet Society. "Further, we do not believe that we should simply take the 1988 regulatory model that applied to the old telephone system and apply it to the Internet," she said.

A proposal offered by a European association of telecommunications network operators would put pressure on content providers such as Google, Facebook and Netflix to offset the costs of delivering Internet traffic to end-users. Traffic increasingly includes bandwidth-hungry video, and the proposal from the European Telecommunications Network Operators' Association essentially argues that the investment needed to expand and improve data delivery should be borne by the operators and the content providers.

Verveer called the proposal unworkable and said it would have unintended consequences, such as blocking Harvard, MIT and other universities from putting courses online at no cost to users in places where access to education is already limited. "If it became necessary to pay in order to make these courses available, they would predictably become less available, which would be very unfortunate," he said.

Even what appear to be minor alterations to the treaty can have far-reaching consequences. A coalition of Arab states has proposed expanding the treaty's definition of telecommunications by adding the word "processing." The change, if made, would "essentially swallow the Internet's functions with only a tiny edit to existing rules," Robert McDowell, a Republican member of the Federal Communications Commission, said late last month at a congressional hearing.

The threat to Internet freedom won't come in the form of a "full-frontal assault," McDowell said at the hearing, "but through insidious and seemingly innocuous expansions of intergovernmental powers." His warning resonated with members of the House Energy and Commerce communications and technology subcommittee.

Several lawmakers questioned Verveer, who also testified, and McDowell about the relationship between Russian President Vladimir Putin and Toure, the ITU's secretary general. Their fear is that Putin, who long has pushed for centralized control of the Internet, will use his allegedly close ties to Toure to accomplish that goal. Toure, a native of Mali, received advanced degrees in electronics and telecommunications from universities in Moscow and Leningrad.

"Is this relationship a concern?" asked Republican Rep. Greg Walden, the subcommittee's chairman. "What steps are we taking to be able to counterbalance that relationship?"

Verveer told Walden he has no doubts about Toure's honesty and fairness.

But McDowell struck a more ominous tone. Putin's "designs" need to be taken very seriously, he said, and urged proponents of Internet freedom to be on guard for "camouflaged subterfuge" that could threaten the Internet's future.

Vote result delay frays Egyptian nerves

CAIRO (Reuters) - Allegations of fraud delayed the result of Egypt's presidential election on Thursday, fraying nerves as the Muslim Brotherhood, which claims victory, called for street protests against moves by the ruling generals to deny them power.

Hundreds of protesters gathered for a third day in Cairo's Tahrir Square, cauldron of the revolution that overthrew Hosni Mubarak 16 months ago, to demand that the officers who pushed him aside keep their word and hand over to civilians by July 1.

There is little sign that will happen after the ruling military council dissolved the Islamist-led parliament and set strict limits on the new president's powers. But prominent Islamists dampened talk of violence, for all their promise of permanent town square vigils until their demands are met.

The state election committee has spent four days collating counts from the two-day run-off ballot but said it would miss a target of Thursday for announcing the result as it was going through hundreds of complaints from both sides. As the weekend starts on Friday, that might mean a wait until Sunday.

"We are taking our time to review the appeals to investigate them properly but, God willing, the results will be announced by Sunday at most, if not before that," Judge Maher el-Beheiry, a member of the election committee, told Reuters.

The candidates, Ahmed Shafik, a former general and Mubarak aide, and the Brotherhood's Mohamed Morsy have both called for national unity as the delay jangled the nerves of a nation increasingly suspicious of the military and the Mubarak-era establishment, or "deep state", that survived the revolution.

Some see the delay as a bid to pressure the Brotherhood to accept the military decree that curbed the president's powers before any Morsy presidency. The committee insists it is simply a procedural issue to ensure all appeals are fairly assessed.

CRISIS

"Egypt on the verge of exploding," Al-Watan daily wrote in a front-page headline, highlighting worries about how supporters of rival camps will respond if their candidate loses. "Security alert before the presidential result," wrote Al-Masry Al-Youm.

"The interest of the nation goes before narrow interests," said reformist politician Mohamed ElBaradei on Twitter. "What is required immediately is a mediation committee to find a political and legal exit from the crisis. Egypt is on the verge of explosion."

Cairo's cafes and social media were alive with chatter about troops preparing to secure major cities, but military sources played down the idea that there was any unusual activity beyond extra alertness.

Adding to unease, Mubarak was himself back in the news, being let out of the prison where he began a life sentence this month for treatment at a military hospital. Security sources have said the 84-year-old was slipping in and out of a coma but "stabilising". Many Egyptians suspect the generals are exaggerating to get their old comrade out of jail.

The political uncertainty has taken its toll on an already battered economy. The pound has hit a seven-year low against the dollar, and Egypt's benchmark share index has tumbled 17 percent since the first round of the vote in May.

In a nation where vote-rigging was the norm during 60 years of military rule, and which is reeling from what critics called a "soft coup" by the generals in the past week, the results delay fuelled mutual suspicions of foul play.

"There is absolutely no justification for the result of the vote to be delayed," Muslim Brotherhood leader Essam el-Erian told Al-Jazeera on Wednesday, describing complaints from the Shafik camp as either invalid or too few to affect the result.

He called on Shafik to show "chivalry" and accept defeat.

Morsy said within hours of polls closing last Sunday that he had beaten Shafik by 52 percent to 48 percent, figures the Brotherhood has stuck to, citing its detailed collation of local results.

Shafik's camp said on Wednesday it remained confident that its man, whom Mubarak appointed prime minister during the uprising, would win, although a spokesman for Shafik also described the vote as "too close to call".

NEGATIVE VOTING

The spokesman accused the Brotherhood of divisive tactics by trying to pre-empt the state election committee, but pledged to honour any result: "In the event that candidate Morsy is indeed successful," he said, "the first telephone call that he will receive will be from candidate Shafik."

If defeated, Shafik would be willing to serve in a Brotherhood government or other post, he said, and if victorious, the former air force commander would appoint an Islamist as one of three vice presidents, and would offer ministerial posts to the Muslim Brotherhood.

The election showed strong support on both sides of the run-off after many Egyptians were disappointed by the elimination of other candidates in last month's first round, but many voted negatively - against Shafik because he was of the old government, or against Morsy and the prospect of religious rule.

The young, secular urban activists who were inspired by the overthrow of Tunisia's dictator to rise up against Mubarak in the Arab Spring have been dismayed by the success of the Muslim Brotherhood, based on its decades of clandestine organisation. But many put aside their qualms to back Morsy in the run-off.

"Any attempt to impose Shafik, any attempt at manipulation by the military council to impose him on us, will take Egypt into a period of instability and tension," Ahmed Maher of the April 6 youth protest movement told Reuters.

"We will take to the streets and protest."

Whoever is declared winner, the next president's powers have already been curbed in the last-minute decree issued by the army after it ordered the dissolution of the Islamist-led parliament.

The European Union on Wednesday joined the United States, both major aid donors, in expressing "concern" at what the army moves meant for a promised transition to democracy. But with the Egyptian army still, as it was throughout Mubarak's 30 years in power, a major ally in the confrontation with militant Islam, Western pressure on Cairo's generals may be limited.

On Tuesday, election monitors from the Carter Center, founded by former U.S. President Jimmy Carter, who brokered the peace between Egypt and Israel that unlocked U.S. aid, said they could not call the election free and fair as they were denied sufficient access to polling stations and results collation.

The Brotherhood has called for open-ended protests against the army's decree to limit the president's role and retain powers, But said it would not resort to violence.

"We are fighting a legal struggle via the establishment and a popular struggle in the streets," Saad al-Katatni, speaker of the dissolved parliament, told Reuters. "This is the ceiling. I see the continuation of the struggle in this way."

    ?Former New York City Mayor Ed Koch was famous for asking, ?How am I doing?? Now it seems every company in America is asking the same thing. As social media site proliferate, we?re being flooded with requests to take customer satisfaction surveys.?

    Get an oil change and you?ll be asked to take a survey. Go the theater? Make sure to rate your experience. After a recent trip to Philadelphia, the hotel, airline and rental car company each emailed me a survey request.?

    A good friend recently received a survey form in the mail from the funeral home that handled his mother?s burial just two months ago. They wanted him to rate his experience. Ugh.?

    What?s going on here??

    ?You?re getting so many survey requests because companies understand how important the customer experience is in today?s ultra-competitive world where consumers have lots of choices,? said Larry Freed, president of ForSee, a company that collects about 1.5 million surveys a month for companies across the country. ?They?ve got to work really hard to meet your needs and exceed your expectations.??

    While many companies truly want your opinion to provide better products and services, some also use surveys to gather personal information in order to improve their marketing. How can you tell the difference? It?s often impossible to tell.?

    A good survey should be about the customer experience and not about marketing, Freed says.?

    ?We want it to be real. We want to be honest about what we?re trying to learn from you and why,? he says.?

    A good survey is respectful of your time. ForeSee surveys are designed to take between 2.5 and 3.5 minutes to be completed on the web and just 60 to 90 seconds on a mobile device.?

    ?When done correctly, it?s kind of a win-win,? Freed says. ?It should be good in the long run for the consumer and also provide really valuable insight for the company that?s doing it.??

    How should a company deal with this feedback?
    ?The critical part of the process is to act on that feedback,? says Lonnie Mayne, CXO (that?s Chief Experience Officer) at Mindshare Technologies. ?When we give feedback, we?re asking for action.??

    Mindshare?s online survey technology provides alerts when a response is negative. At Tony Roma?s, that email alert goes to the store manager who is required to contact the customer within 24 hours.?

    ?We respond to every single complaint to make sure that we rectify the situation and solve the problem,? says Bradley Smith, the restaurant chain?s executive vice president.?

    Smith tells me about 40 percent of the responses are compliments. But good or bad, the company uses the feedback to improve and grow.?

    ?It?s very important to us as we make strategic decisions from menu items, staffing, d?cor and even possible new locations,? Smith says.?

    With the increased use of surveys comes the risk of customer fatigue. But survey firms report that younger people who grew up with social media are eager to share their opinions. They tend to appreciate and respond to online surveys.?

    Surveys are starting to change. Instead of asking 15 or 20 structured yes/no or multiple choice questions, they?ll ask for comments. How was the experience? How can we improve? What did you like? What didn?t you like?

    You?ll be able to type in a response on the web or just talk on the phone. Technology that can analyze text and voice is making this possible.?

    ?Now that?s a lot more user-friendly,? says Mindshare Technology?s Mayne. ?Again, you still have to act on it. But that?s the future; that?s where we?re headed.??

    My two cents
    I don?t mind getting surveys when the questions seem relevant (designed to improve customer service) and do not ask for personal information. I also appreciate it when the company tells me how long it should take to complete the survey. Note to companies: If it?s more than about 3 minutes, you need to cut down the questions.?

    I love to get notices from companies that let me know about a change that?s been made because of customer feedback. That lets me know they?re listening and responding. That?s a big plus in my book.?

    I also believe that any company that wants my opinion should give me the option to give them contact information. I also believe that if my answers indicate a less than satisfactory experience and I give the company my phone number or email, they have a responsibility to get back to me. If they don?t, they should consider me a former customer.?
